2. Purpose and Scope
These General Terms and Conditions of Sale (hereinafter the “Terms”) exclusively govern the sale of products offered on the website www.miafitclub.com (hereinafter the “Website”) by Mialabo (hereinafter “Mialabo”) to consumer customers (hereinafter the “Customer”).
These Terms define the conditions of ordering, payment, delivery, and management of any returns.
Any order implies full and unconditional acceptance of these Terms. They may be modified at any time. The applicable Terms are those in force at the date of the order.
These Terms are governed by French law. Consumers residing in another EU country also benefit from the protective provisions of their national law in accordance with the Rome I Regulation.

4. The Customer
Mialabo products (hereinafter the “Products”) are intended for final consumers (individuals) or non-professional legal entities, excluding resellers or intermediaries acting on behalf of resellers.
The Customer confirms acting as a final consumer and not for resale purposes.
The Customer must be a legally competent adult.
Orders require either account creation or guest checkout, with accurate, complete, and up-to-date information.
Mialabo reserves the right to refuse any order that does not comply with its commercial policy.
5. Products
5.1 Description
Products offered are those displayed on the Website at the time of consultation.
Product images and descriptions are provided for illustrative purposes only. Minor differences in color, shape, or texture may occur due to display settings or manufacturing processes. These do not affect the essential characteristics of the product.
Some variations in finish, size, or shade may occur due to materials or production methods. These are not considered defects.
Customers may obtain additional information by contacting customer service.
5.2 Prices
Prices are indicated in euros, including VAT (20%), excluding shipping costs.
The final price is displayed before order confirmation.
Mialabo reserves the right to change prices at any time.
5.3 Pre-orders
Certain products may be offered for pre-order at preferential pricing, valid only during the pre-order period.
Estimated delivery dates are provided at the time of order and are indicative. Delays may occur due to production or logistics issues. Customers will be informed by email in case of significant changes.
6. Orders and Pre-orders
6.1 Account or Guest Checkout
Customers may order via an account or as a guest.
They are responsible for the accuracy of their information and their login credentials.
6.2 Ordering Process
Add to cart → review → select delivery → accept Terms → payment → confirmation email.
6.3 Pre-orders
Pre-orders do not constitute a deposit contract. Delivery times may vary from a few days to several weeks.
7. Payment Terms
Products are payable in full at the time of order.
The Customer guarantees they are authorized to use the chosen payment method.
Payments may be made via:
- Credit card via the Cawl platform of Crédit Agricole
- Installments (3–4 payments) via Klarna
Accepted cards: Visa, Mastercard, Carte Bleue.
Customers contract directly with the payment provider. Mialabo does not store banking details.
Transactions are secured via 3D Secure and processed exclusively by the payment provider.
Payment authorization is irrevocable once validated.
If payment fails, the order is automatically canceled.
Installment payments may also be offered via Alma for purchases between €350 and €8,000, subject to acceptance.
8. Delivery
Orders shipped outside France may be subject to customs duties and taxes, payable by the Customer.
Delivery is available in metropolitan France, Switzerland, and EU countries.
Delivery address must be within these areas.
Delivery times are indicative and depend on carriers (Colissimo, GLS).
Orders placed before 12:00 PM (France time) are shipped the same day (business days).
Made-to-order items may require longer delays (weeks or months).
9. Right of Withdrawal and Returns
Customers have 14 days from delivery to exercise their right of withdrawal.
Products must be returned in perfect condition, unused, complete, and in original packaging, with proof of purchase, to:

Return shipping costs are borne by the Customer unless the product is defective or non-compliant.
Refunds are processed within 14 business days after inspection.
Conditions for acceptance:
- Product unused and undamaged
- Not custom-made
- Returned with original packaging and invoice
10. Refunds
Refunds are made via the original payment method in euros.
Currency conversion differences and fees remain the responsibility of the Customer.
11. Legal Guarantees
11.1 Conformity Guarantee (2 years)
In accordance with French Consumer Code, the seller guarantees product conformity for 2 years.
Customers may request repair or replacement.
11.2 Hidden Defects Guarantee
Under Articles 1641–1649 of the French Civil Code, Customers may claim for hidden defects.
12. Intellectual Property
All website content is the exclusive property of Mialabo.
Any reproduction or use without authorization is prohibited.
13. Personal Data
Personal data is processed in accordance with applicable laws.

14. Force Majeure
Mialabo shall not be held liable for delays or failures due to force majeure events beyond its control.
15. Dispute Resolution
These Terms are governed by French law.
In case of dispute, an amicable solution will be sought before legal action.
16. Language
These Terms are originally written in French.
In case of translation, the French version shall prevail.
17. Entry into Force
These Terms apply from September 1, 2025.
